Petitions for Removal from Sex Offender Registry
Petitioning for removal from the sex offender registry depends on your conviction and /or disposition.
The following are not eligible for relief: A sexually violent predator; sexual assault; sexual assault in the first degree, as it existed prior to July 1, 2000; sexual assault in the second degree, as it existed prior to July 1, 2000; sexual assault on a child; sexual assault on a child by one in a position of trust; sexual assault on a client by a psychotherapist; incest; aggravated incest; any adult who has more than one conviction for unlawful sexual behavior
Any other Class 1, 2, or 3 felony offender is eligible for removal 20 years after discharge from incarceration or release from the jurisdiction of the court.
Class 4, 5, or 6 felony offenders are eligible for sex offender registry removal 10 years after discharge from incarceration or release from the jurisdiction of the court.
Class 1 misdemeanor of unlawful sexual contact, or third-degree sexual assault as it existed prior to July 1, 2000, are eligible for registry removal 10 years after discharge from incarceration or final release from the jurisdiction of the court.
All other misdemeanors are eligible for removal from the Colorado sex offender registry 5 years after final release from the jurisdiction of the court.
Offenders under the age of 18 at the time of adjudication and offenders with a deferred judgment and sentence or adjudication are eligible for removal after the successful completion of the sentence unless otherwise stated by the court.
